General Terms and Conditions (GTC) for Holiday Rentals
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts for the rental of holiday apartments on the island of Brač, Croatia, concluded between the landlord and the tenant via the landlord’s website.
2. Conclusion of Contract
The rental agreement comes into effect upon confirmation of the booking by the landlord. Bookings can be made in writing, by email, or via the booking form on the website.
3. Rental Duration and Arrival/Departure
• The rental period is specified in the rental agreement.
• Check-in is from 3:00 p.m., check-out by 10:00 a.m.,
unless otherwise agreed.
4. Rental Price and Payment Terms
• The rental price is based on the current price list on the website.
• At the time of booking, 50% of the rental price is due. The remaining balance must be paid 30 days prior to arrival.
5. Withdrawal and Cancellation
• The tenant may cancel the contract at any time. Cancellation must be made in writing.
• If the discount code “KEINSTORNO” is used—regardless of the amount of the discount—no refund will be given in the event of a cancellation or no-show.
• Cancellations up to 30 days before arrival are free of charge.
• For cancellations within 30 days before arrival, the full rental amount is due as a cancellation fee.
• In the case of a no-show, the tenant will pay a fee equal to the total booking price. The deadlines for free cancellation apply according to the time zone of the accommodation.
6. Duties of the Tenant
• The tenant agrees to treat the holiday apartment and its inventory with care.
• Any damages occurring during the rental period must be reported to the landlord immediately and compensated for by the tenant.
7. Landlord’s Liability
• The landlord shall not be liable for damages caused by force majeure, natural disasters, or other unforeseeable events.
• The landlord is only liable for damages resulting from intentional or grossly negligent breaches of duty.
8. House Rules
• The house rules, available in the holiday apartment, are part of the rental agreement and must be observed by the tenant.
• Quiet hours must be observed from 10:00 p.m. to 7:00 a.m.
9. Data Protection
• The tenant’s personal data will be used exclusively for processing the rental agreement and will not be shared with third parties, except for fulfilling legal obligations.
• The landlord is obligated to report guest information to the relevant Croatian authorities for tourist tax purposes. This usually includes name, address, date of birth, ID number, and length of stay.
• By booking, the tenant agrees to this transfer of personal data.
10. Final Provisions
• Changes and additions to the rental agreement must be made in writing.
• Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
• The law of the Republic of Croatia applies.
